What to Expect from a Home Office Pre-Licence Compliance Check in 2025

This weekend (16 February 2025), our Director, Gavin Webster attended an online Home Office Pre-Licence Compliance Check, essentially a pre-licence audit for a client who had applied for a Sponsor Licence. Yes, they do work weekends! Gavin was there as an observer while the Home Office Compliance Officer conducted the interview with our client, who is the company's Authorising Officer.

Having sat through many Home Office audits over the years, this was our first one of 2025, so Gavin thought he'd share some insights on what happened.

How the compliance check was conducted

The MS Teams video call began with identity verification, where the Compliance Officer asked our client to provide ID and confirm personal details. From there, the questions became more detailed, covering the company’s background, sponsorship justification, and internal processes.

Business overview and need for a sponsor licence

The compliance officer asked our client:

  • What the company does and how long it has been trading.
  • Why the business needs a sponsor licence.
  • Who prepared the sponsor licence application, whether any assistance was received, and who ultimately submitted it.

These questions aim to confirm that the business is genuine, has a legitimate need for overseas workers, and understands the responsibilities that come with holding a sponsor licence.

The Pre-Compliance Check Document Request

Before the online compliance check took place, the Home Office sent our client a list of required documents that needed to be provided within just five working days. Given that our client had paid the additional £500 for the priority service, which should have resulted in their application being processed within 10 working days (yes, we know it's not guaranteed, but the fact the fee is not refundable doesn't sit right), but instead took six weeks before they were even notified that a compliance check was required, this short deadline feels like a bit of an ask.

Screenshots of the following from your HR systems:

  1. Employee personal details, including Name, Date of Birth, and Emergency Contact details.
  2. Supporting information showing the right to work checks you have completed on your current employees and the evidence you have retained for these checks.
  3. Contracts of employment for your current employees and a draft contract for any future roles you wish to assign certificates of sponsorship to.
  4. Business or corporate bank statements for the last three months showing the current transactions you are making and any other bank accounts relevant to your business. These must include any salaries paid to employees. (Please note bank statements must be complete and show an opening and closing balance for each month reported. Incomplete bank statements will not be accepted.)
  5. Employee annual leave and other absences.
  6. The immigration status of your employee(s) and how you monitor the length of their visa(s).
  7. Supporting information showing the workplace pension scheme your business offers to eligible employees.
  8. Passports or other proof of ID for current employees.
  9. Copies of all current official client contracts (if applicable), including the start date, volume of work required, and the resourcing requirements to service these.

The short timeframe of only five working days to gather and submit these documents highlights the importance of having well-organised HR, payroll, and compliance records in place before applying for a sponsor licence.

How the Compliance Check Was Conducted

During the video call, the compliance officer reviewed the submitted documents and proceeded to question our client on key areas of sponsor compliance, including their business operations, their knowledge of sponsor duties, and their processes for managing sponsored workers.

The compliance officer asked our client:

  • What the company does and how long it has been trading.
  • Why the business needs a sponsor licence.
  • Who prepared the sponsor licence application, whether any assistance was received, and who ultimately submitted it.

The aim of these questions was to assess whether the business has a genuine need for sponsorship and whether the authorising officer understands their responsibilities.

Document Verification and System Checks

As part of the assessment, our client was required to share their screen to verify key information further. This included:

  • Bank transactions showing salary payments for existing employees.
  • Payslips.
  • A live login to the company’s pension scheme to confirm active enrolments.

These checks help the Home Office verify that the company is financially stable and has proper payroll processes in place.

Right to Work Checks and Reporting Duties

The compliance officer tested our client’s knowledge of right to work checks and sponsor reporting duties. Key questions included:

  • How would they verify right to work for a sponsored worker.
  • What steps would they take if a worker’s visa expired or they stopped attending work.
  • How do they track visa expiry dates and ensure compliance.

A business must demonstrate that it has clear processes in place to manage its sponsor duties effectively. Any gaps in understanding could raise concerns about the company’s ability to remain compliant.

Employee Records and Financial Sustainability

The compliance officer also asked about the company’s existing workforce, financial position, and ability to sustain sponsorship over time. This included:

  • Details of current staff, including contracts, salaries, and job roles.
  • Turnover figures and financial stability.
  • Client contracts, where applicable, to demonstrate ongoing business activity.
  • Evidence of funding to support sponsored workers for at least the next 12 months.

The Home Office wants to see that a company has the financial capability and long-term sustainability to support its sponsored workers.

The Outcome and Key Takeaways

Our client was well-prepared, answered all questions confidently, and had the required documents ready. The support we provided paid off, ensuring they demonstrated compliance and a clear understanding of their sponsorship duties.

A pre-licence compliance check is becoming more likely for businesses considering a sponsor licence. The Home Office is looking for organisations that can demonstrate a genuine need for sponsorship, have robust compliance processes, and are financially capable of supporting overseas workers.

The key takeaway? Preparation is everything. Having well-documented HR and compliance systems in place before applying for a sponsor licence will make this process much less stressful!
